When someone gives you a laptop how do you find out if it's stolen not.

Check the Serial number of the laptop.

If you are talking about Surface devices, the following will be handy:

Navigate to the Microsoft Devices page
Attempt to register the device using its serial number-If Microsoft indicates the device is already linked to another account or marked as missing/stolen, that's a warning sign.
Ask for proof of purchase (receipt, invoice, warranty card)

We also see issues with Enterprise devices that are not removed from IT provisioning and are resold or gifted which bootup to a login prompt for a business or education domain. Customers would need to contact that enterprise/edu 's IT department to get the device removed from provisioning. Microsoft can't help in this situation, only the organization which provisioned the device can remove it.
